Strict Liability Doctrine and its Importance in Proving Faults
Technology is very advanced nowadays. Different products are being manufactured that would definitely help people in their daily lives. But what if the product that is supposed to give you comfort and ease are the products that would inflict pain and suffering to you.
A liability lawyer deals with product liability cases wherein the manufacturers, retailers, distributors, etc. are responsible for the injuries inflicted to the plaintiff by the product they have made or by the product they have sold. But because of the large companies that would be faced by the plaintiff, a lawyer must be convincing enough for the plaintiff to pursue the case.
After the details have been explained and the plaintiff has really decided to file a claim, it is his turn to give the evidences and all the details regarding the incident after which the liability lawyer would prove who is really at fault in the injury inflicted by the product to the plaintiff.
Typically, proving who is at fault in an accident requires the plaintiff to prove whether the negligence of someone else’s had caused him to sustain injuries before he can be fully accused of committing negligence therefore responsible for all the legal actions and damages for the plaintiff. But because it would be expensive to prove it and that, sellers are not actually expected to check if the product is defective or not, law makers provided the “strict liability” doctrine.
Strict liability allows the user or consumer injured by a defective product to recover compensation from the manufacturer or the seller of the product without even showing that the manufacturer or the seller is actually negligent. However, there are some rules included in this doctrine, and they are the following:
- The product had unreasonably dangerous defects which had caused an injury to the plaintiff. The defect must have come into existence either in the design of the product, during its manufacture or during shipment.
- The defect caused the injury while the product is being used in the way it is intended to be used.
- The product was not substantially changed from the condition in which it was originally sold.
If you have been a victim of product liability, contact a liability lawyer now and be informed on what you could do to fight for your right as a consumer.
