PRODUCT LIABILITY: LA Resident Sues Apple for Defective iPhone 4 Glass
January 27, 2011
Los Angeles - An LA resident has filed a class action lawsuit against Apple Incorporated over an alleged defective iPhone 4 glass that threatened the life of her young daughter on Tuesday.
According to reports, Donald LeBuhn has filed the suit in behalf of all customers of iPhone 4 over the susceptibility of its glass to crack and shatter into pieces when dropped 3 feet from the ground. His iPhone 4 had a protective cover when her daughter dropped it while sending a message.
LeBuhn brought his broken iPhone to a "mom and pop" shop to avail of its cheaper $50 repair fee compared to Apple's standard $159 re-glassing fee. This move voided his warranty as he allowed a non-official Apple center to repair the phone.
Reports said that LeBuhn decided to file a Product liability suit instead and asserted that iPhone 4 has a manufacturing defect that caused the glass breakage under reasonable use. He reiterated that such defect has threatened the safety of her daughter.
He also commented on how Apple Inc. misled him to believe that the glass is "ultradurable" as stated in its marketing materials.
According to technology reviews, Apple Incorporated has received numerous complaints over iPhone 4’s substandard glass, poor phone reception, and other technical malfunction.
Apple has not yet released an official statement for LeBuhn's case.
